Other Provisions:

Clarifies the definition of a manufacturer to include affiliates. This prevents manufacturers from establishing a “sister” brand to sell direct to consumers while undercutting their franchised business partners and competing directly.

Reimburses dealers for manufacturer-required vehicle loaner programs and vehicle feature subscriptions sold through software upgrades and apps.

Adds a section on data protection to limit the access of third-party vendors to customer data.

Amended by the Senate to address some manufacturer concerns related to customer data and remove licensing of factory representatives.
Technicians are not being fairly compensated by manufacturers for warranty and recall work.
Currently, manufacturers have set unreasonable time restraints on repairs that do not reflect market conditions and result in dealers subsidizing technicians when performing warranty repairs on behalf of the manufacturer. New York and New Jersey have recently enacted similar laws, and Pennsylvania’s technicians are leaving for better pay in neighboring states.
Warranty provisions in SB 1182 establish an optional process that allows dealers to apply for compensation at the retail rate.
Manufacturers have not raised prices in other states who have passed similar legislation and are already prohibited by law from surcharging dealers and thereby their customers who apply for warranty reimbursement.
